Signing App: Terms&Conditions
Effective from: 01 January 2026
Introduction
These Terms and Conditions (“Terms”) govern access to, and use of the Desktop and Mobile Digital Signing Application (“Application”) provided free of charge by the Government of the Republic of Kosovo (“Authority”).
The Application supports electronic identification and electronic signature services in compliance with applicable national legislation and Regulation (EU) No 910/2014 on electronic identification and trust services for electronic transactions in the internal market (“eIDAS Regulation”).
By downloading, installing, registering, or using the Application, the user (“User”) agrees to be legally bound by these Terms.
Purpose of the Application
The Application enables Users to:
- Create electronic signatures and advanced or qualified electronic signatures;
- Perform strong electronic identification;
- Validate signed electronic documents.
The Application may operate as a component of a national electronic identification scheme notified under the eIDAS Regulation.
Legal Framework
The Application operates in accordance with:
- Regulation (EU) No 910/2014 (eIDAS Regulation);
- Applicable national electronic identification and trust service legislation;
- Relevant cybersecurity and data protection legislation;
- Implementing acts and technical standards adopted under eIDAS.
Legal Effect of Electronic Signatures
Electronic signatures created through the Application shall not be denied legal effect or admissibility as evidence solely because they are in electronic form.
Where the Application supports Qualified Electronic Signatures, such signatures shall have legal effect equivalent to handwritten signatures in accordance with the eIDAS Regulation;
The Authority does not review, validate, or assume responsibility for the content of signed documents
Trust Service Roles
The Authority may act as:
- An Electronic Identification Scheme Operator;
- A Trust Service Provider; or
- A Supervisory or Coordinating Authority,
depending on national legal arrangements.
Eligibility
Users must:
- Possess a valid electronic identity credential issued or recognized by the Authority;
- Successfully complete identity proofing procedures compliant with eIDAS assurance levels;
- Maintain control of authentication credentials and devices.
Authentication and Signature Creation
The Application may use strong authentication mechanisms including:
- One-time passwords (OTP) delivered via SMS or other communication channels;
- Device-bound cryptographic keys;
- Biometric authentication supported by the User’s device;
- Secure signature creation environments.
The User acknowledges that successful authentication authorizes signature creation.
Security Requirements
The Authority implements technical and organizational security measures consistent with eIDAS security requirements and national cybersecurity standards.
Users must protect personal devices and credentials, and report suspected compromise or misuse.
Availability and Continuity of Service
The Authority shall take reasonable measures to ensure availability, integrity, and reliability of the Application.
The Authority reserves the right to perform maintenance, modify functionalities, suspend services temporarily, or implement upgrades required for regulatory compliance.
Free of Charge Provision
The Application is provided free of charge by the Authority.
Users remain responsible for telecommunications costs, device procurement, and third-party service charges not controlled by the Authority.
Personal Data Protection
Personal data shall be processed in accordance with applicable data protection laws and official privacy policies.
Processing may include identity verification, certificate lifecycle management, fraud detection, regulatory compliance, and security monitoring.
Record Keeping and Audit
The Authority and associated trust service providers may maintain records of authentication events, signature transactions, security logs, and operational data in accordance with regulatory retention requirements.
User Responsibilities and Acceptable Use
Users agree to use the Application only for lawful purposes, ensure signed documents are lawful and accurate, not compromise security features, and accept legal responsibility for signatures performed using their credentials.
Suspension and Revocation
The Authority may suspend or revoke access where security breaches are suspected, credentials are compromised, legal obligations require intervention, or Users violate these Terms.
Limitation of Liability
To the extent permitted by law, the Authority shall not be liable for losses arising from User negligence, unauthorized use of compromised credentials, service interruptions caused by telecommunications providers, or legal consequences of signed documents.
Updates and Regulatory Compliance
The Authority reserves the right to amend these Terms to ensure compliance with evolving regulatory, security, and operational requirements.
Continued use of the Application constitutes acceptance of updated Terms.
Intellectual Property
All intellectual property rights related to the Application remain the property of the Authority or its licensors.
Users receive a limited, revocable, non-exclusive license to use the Application for its intended purposes.
Governing Law and Jurisdiction
These Terms shall be governed by the laws of Kosovo, interpreted in accordance with applicable European Union law.
